
DUI Information for a first time DUI.
DUIs are quite complicated. They depend on the following factors:
Did you provide a breath sample?
if no
– it’s a Refusal
– with its own penalties different from that if you had provided a breath sample
What was the alcohol level?
– if one blows above a .15, then higher maximum jail time, greater possible length of license revocation, larger minimum and maximum fine
Was there a minor(person under the age of 18) in the car?
– then it’s the same as if you blew over a .15
– including interlock device.
Was there a crash?
– higher maximum jail, higher fines, higher length of suspension of drivers license.
First Time DUI – A Complex Crime

Different counties have different programs for first time offenders. Most counties do NOT have a first time offender or diversion program. In the areas that I serve, a typical first time DUI conviction (if you plead or are found guilty at trial) may carry the following penalties:
First time DUI with a blow above .08 and below .15
– An Adjudication of Guilt (means you can never seal or expunge your criminal record)
– up to 180 days in the county jail
– 12 months of supervised probation (random drug tests and paying the probation office(cost of supervision between $30 and $60.00 per month)
– ten day vehicle impound (you must turn in the tag or pay a service)
– Level I DUI class (12 hours, includes substance abuse evaluation, appx: $260.00 and up)
– Victims Awareness Class
– 50 hours community service
– six month drivers license revocation by the Judge (different from the administrative DUI suspension by the Department of Motor Vehicles
– Random urinalysis
– substance abuse evaluation and recommended treatment
– Minimum fine of $500.00 and maximum fine of $1000.00
– Court Costs, Cost of Investigation and Cost of Prosecution.
First time DUI with a blow above .15 OR with a child under the age of 18 in the car
-An Adjudication of Guilt (means you can never seal or expunge your criminal record)
– up to 270 days in the county jail
– 12 months of supervised probation (random drug tests and paying the probation office((cost of supervision between $30 and $60.00 per month
– ten day vehicle impound (you must turn in the tag or pay a service)
